Next day of the trial court of Ahmedabad convicted Vismay Shah to five year jail term for running over 2 youths in the Vastrapur BMW hit-and-run case, he moved Gujarat high court on Tuesday challenging his conviction and requesting bail.
Vismay’s appeal against lower court’s order and bail plea is likely to come up for hearing before Justice S G Shah on Wednesday.
Vismay has asked the additional sessions judge P M Patel’s decision to hold him guilty of rash driving and culpable homicide on the grounds that 2 eye witnesses – Lalit Gupta and Dinesh Chaudhary – did not identify him during their deposition. Another witness, Mitesh Shah, who identified him in courtroom, had named him for the first time since the incident, whereas Shah himself had never told cops that he had seen Vismay on the spot of accident on February 24, 2013.
